Terms of Service
Effective November 1, 2026
The short version.
- You are the sender of every email you send through LocatingLeads, and you are responsible for following the law, including CAN-SPAM.
- Nothing is sent until you approve it. Read each draft before you approve it.
- Plans renew monthly until you cancel. You can cancel any time.
- We can pause or close accounts that break the Acceptable Use Policy.
These terms are an agreement between you and Ty Ciccarello, a sole proprietor in Florida doing business as LocatingLeads ("we", "us"). They cover your use of locatingleads.com and app.locatingleads.com (the "Service"). By creating an account, you agree to these terms, to the Acceptable Use Policy, and to how we handle data as described in the Privacy Policy.
1. Who can use the Service
You must be at least 18 and use the Service for a business. If you sign up for a company, you confirm that you are authorized to accept these terms for it, and "you" means that company. Keep your password safe. You are responsible for everything done through your account.
2. What the Service does
The Service finds local businesses from public sources, audits their websites and Google Maps listings, writes draft outreach emails with an AI model, and sends the drafts you approve from your own Gmail account, along with follow-ups you approve.
- Drafts are written by AI and can be wrong. Read every draft and correct anything inaccurate before you approve it. You are responsible for what you send.
- Audit scores and findings are automated estimates, not professional advice, and may be incomplete.
- Business information comes from third parties such as Google and the businesses' websites. We don't guarantee it is accurate or current.
3. Your responsibilities as the sender
Emails sent through the Service are sent by you, from your email account, under your name. You are the sender under the CAN-SPAM Act and any other law that applies to your messages. You agree to:
- identify yourself and your business truthfully and use subject lines that are not misleading;
- include a valid physical postal address for your business (the Service adds the one you enter in Settings);
- keep the unsubscribe link the Service adds, and not try to email anyone who has unsubscribed (the Service blocks this automatically);
- contact businesses only, not consumers, and follow the Acceptable Use Policy;
- follow Google's and Gmail's terms for your Google account.
You will defend and reimburse us for claims, fines and costs (including reasonable attorneys' fees) that arise from the emails you send or from your breaking these terms or the law.
4. Plans, trials and billing
- Subscriptions. Paid plans are billed monthly in advance through Stripe, and renew automatically each month until canceled. Each plan includes monthly limits on searches, drafts and audits, and a daily sending limit, shown on the Billing page. Unused limits don't carry over.
- Free trial. New customers get a 7-day free trial with smaller limits. A card is required. Unless you cancel before the trial ends, your plan starts and your card is charged.
- Canceling. Cancel any time from the Billing page. Your plan stays active until the end of the period you've paid for, and is not renewed after that.
- Refunds. Payments are not refundable, including for partial months or unused limits, except where the law requires otherwise.
- Failed payments. If a payment fails, searching, drafting and sending pause until it is paid. Your data stays available.
- Price changes. We will email you at least 30 days before a price change takes effect. If you don't want the new price, you can cancel before it applies.
- Prices don't include taxes. You are responsible for any taxes that apply.
5. Pauses, suspension and termination
To protect recipients and every other customer's ability to send, the Service automatically pauses sending on an account whose recent emails have unusually high bounce or unsubscribe rates. We may also pause or close an account, with or without notice, if we reasonably believe it breaks these terms or the Acceptable Use Policy, puts the Service or others at risk, or is required by law. We will tell you why when we can, and you can write to us to ask for sending to be resumed.
You can close your account any time in Settings. Closing it cancels your subscription and deletes your data as described in the Privacy Policy.
6. Your data
You keep ownership of the data you put into the Service and the emails you send. You give us permission to store, process and transmit it only as needed to provide the Service to you. You confirm that you have the right to use any data you upload or have the Service collect for you.
7. Our Service
We own the Service, its software and its design. We give you a limited, non-transferable right to use it while your account is open and in good standing. Don't copy, resell, reverse-engineer or try to get around its limits or protections. If you send us feedback, we can use it without owing you anything.
8. Other services
The Service depends on third parties, including Google, Stripe, Anthropic and our hosting providers. Their terms apply to your use of their services, and we're not responsible for their outages or changes. If a provider changes or withdraws something the Service relies on, we may have to change or remove a feature.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Service will be uninterrupted or error-free, that emails will be delivered or answered, or that you will get any particular business results.
10. Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim arose.
11. Changes to these terms
We may update these terms. If a change is significant, we will email you, and we may ask you to accept the new terms before you keep using the Service. The date at the top shows the current version.
12. Law and disputes
These terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-law rules. Any dispute will be decided in the state or federal courts located in Florida, and both sides agree to those courts' jurisdiction. Before filing a claim, please write to us so we can try to resolve it informally.
13. General
These terms, the Acceptable Use Policy and the Privacy Policy are the whole agreement between us about the Service. If part of these terms can't be enforced, the rest still applies. Not enforcing a term isn't a waiver of it. You can't transfer these terms without our consent. We can transfer them as part of a sale or reorganization of the business.
